Investment Protection and Nigeria’s Energy Transition
Nigeria’s renewed drive to attract petroleum
investment is creating long-term commercial
commitments at a time when the country
needs greater flexibility to manage public
revenues, enforce environmental obligations
and pursue its energy transition. This
research work examines how bilateral
investment treaties (BITs) and investor–State
dispute settlement (ISDS) interacts with
Nigeria’s offshore investment strategy, the
Decade of Gas initiative and environmental
accountability. Drawing on treaty provisions,
arbitration records, government policies,
project-level evidence and stakeholder
consultations, it identifies gaps in the
assessment and management of investment-
related legal, fiscal and environmental risks.
