Consultancy Services: Investor-State Dispute Settlement (ISDS), Investment Governance and Nigeria's Energy Transition
Policy Alert is a Nigerian civil society organisation working on extractive industry governance, environmental justice, and the rights of communities in the Niger Delta. Our work spans research, policy advocacy, grant-supported programming, and community engagement on issues including gas flaring accountability, the implementation of the Petroleum Industry Act (PIA), and the governance of Nigeria's energy transition.
A growing but underexamined dimension of this transition is the exposure of Nigeria to Investor-State Dispute Settlement (ISDS) claims under its network of Bilateral Investment Treaties (BITs). ISDS mechanisms allow foreign investors to sue host states directly before international arbitration tribunals, often bypassing domestic courts, and can expose governments to substantial financial liability for environmental, regulatory, and social protection measures. As Nigeria pursues both its climate commitments and its Decade of Gas initiative, the risk that ISDS provisions will constrain environmental governance, delay energy transition policy, and shield extractive companies from environmental and community liability during divestment is significant and largely unaddressed in Nigerian policy discourse.
Policy Alert is seeking a qualified consultant or consulting team to undertake a critical study of Nigeria's ISDS exposure, with a particular focus on offshore oil and gas investment, the Nigeria–Netherlands BIT, and the implications for Niger Delta communities, and to support civil society capacity-building on these issues.
